Nairobi, Kenya: The Kenyan Court is expected to make a landmark ruling on Monday, 6th February 2023 whether they have the Jurisdiction to hear a case lodged by an alleged former employee of Facebook. 

This comes after Daniel Motaung, a former employee of Facebook under their parent company Meta, filed a case in court on allegations of worker exploitation and abuse while working as an alleged Facebook Moderator.

The former Facebook employee seeks fundamental changes to Facebook’s factory moderation hub for East and Southern Africa which is allegedly based in Nairobi.

Facebook is seeking to have the case dismissed for want of jurisdiction saying that it has no registered office in Kenya and has no operations in the country. 

Daniel alleges he began work at the Nairobi office, managed by subcontractor Sama, as a content moderator in 2019 without knowing who he was really working for, nor the nature of the job or the serious risk posed to his health. Motaung, alleges he has contracted serious Post Traumatic Stress Disorder (PTSD) as a result of his time as a moderator. 

The ruling that is expected by the Employment and Labour Relations Tribunal comes as further allegations against Facebook in a second case in Kenya’s High Court are pending for promoting hate speech which they are alleged to have incited violence in the alleged ongoing Ethiopian conflict.
